JIPA Design, LLC (“JIPA”, “we”, “us”, “our”) provides this Terms of Use, Privacy Policy & Cookie Policy (“Privacy Policy”) to let you know our policies and procedures regarding the collection, use, and disclosure of information through www.jipadesign.com (“Site”), and any other websites, features, applications, widgets or online services that are owned or controlled by JIPA and that post a link to this Privacy Policy (together with the Site), as well as any information JIPA collects offline in connection with information or services we provide (“Service”, “Services”).

It also describes the choices available to you regarding the use of, your access to, and how to update and correct your personal information. Note that we combine the information we collect from you from the Site, through our Services generally, or offline.

By accessing or using the Site, you consent to the information collection, disclosure, and use practices described in this Privacy Policy. Please note that certain features or services referenced in this Privacy Policy may not be offered on the Site at all times.

Overview of our Privacy Policy

California law requires us to ensure the privacy of our clients’ personal information and requires us to provide information to you regarding our Privacy Policy and the designated means by which you may inquire about our policy.

As a California corporation, we value our clients and take issues regarding privacy very seriously. Please read this Privacy Policy to learn more about the ways in which we use and protect your personal information. Our Privacy Policy describes the personal information we collect about you, why we collect it, and how we use it. It also describes the choices you can make about how we collect and use your personal information for our business purposes.

If our practices change in the future, we will post an updated Privacy Policy on our Site. You can tell if the Privacy Policy has changed by checking the effective date that appears at the end of this policy. You may exercise your choices about how we collect and use your personal information at any time.

What information does JIPA collect?

We only collect the information that you choose to provide. In accordance with California Civil Code Section 1798.83, et seq., California Business & Professions Code Section 22575 et seq., and other applicable California privacy laws as amended from time to time, when you visit our Site or request information from us, we collect personal information, such as your name, addresses, email addresses (“email”), telephone numbers (“phone”), website URLs, business affiliation, and any other information that you choose to provide.

We may collect personal identification information from you in a variety of ways, including, but not limited to, when you submit information through the online submission form available on the Contact page of our Site (“Contact Form”), email us, place an order, fill out a form, respond to a survey, and/or in connection with other activities, Services, features or resources we make available on our Site. Note, we may ask for additional information to be determined as needed in order to fulfill our Services to you. We may maintain a record of your interests and inquiries.

Our Site only collects generic information regarding your visit. See the next section.

Does JIPA use cookies?

No. We respect your privacy, and we are compliant GDPR, CCPA, PECR, and cookie laws. Our Site does not use cookies, trackers, or similar technologies, browser cache, or local storage to track or store your information. Except data submitted through our Contact Form, our Site does not collect any personal data or personally identifiable information (PII).

We collect anonymous data, including:

  • how you arrived at our Site using an HTTP referrer
  • data related to pages you’ve viewed while visiting our Site
  • your browser, operating system, and device type
  • your country, region, city–note, we do not have access to your IP address, street address or GPS location.

California Do Not Track Notice

Our Site currently has Do Not Track (“DNT”) active, which means our Site will not track your activities on the internet. We do not track our visitors over time and across third party web sites to provide targeted advertising, and therefore currently, our Site does not respond to DNT signals.

DNT is a mechanism for allowing Internet users to control the tracking of their online activities across web sites. Currently, various browsers (including, but not limited to, Chrome, Edge, Firefox and Safari) offer a DNT option that relies on a technology known as a DNT header, which sends a signal to web sites visited by the browser user about the user’s DNT preference. You can usually access your browser’s DNT option in your browser’s preferences.

How does JIPA use my personal information?

When you contact us through our Site or email, we use the personal information you provide to respond to you via email, video calls, phone (including text messages), offline, mail, or other method of communication in accordance with your request.

We may contact you to provide information about our Services, events, or promotions; to learn your preferences; to learn how we can improve our offerings, Site design, and your online experiences; in the unlikely event of a security breach, a change in company ownership, or law enforcement request; to better administer and troubleshoot problems with the Site; and/or other reasons subject to your privacy choices.

Does JIPA share my personal information with third parties?

Except as otherwise provided in this Privacy Policy, we do not sell, trade or rent the personal information you voluntarily share with us to third parties for marketing or commercial purposes without your consent.

We may contract with third party providers to maintain, manage, or fulfill our Services, Site, or communications with you, including, but not limited to third parties such as WordPress.org/.com, WP Statistics/VeronaLabs, Hostinger/Hosting Media, BlueHost/Newfold Digital, Elementor Ltd., Redbubble.com, Printful Inc, Mailchimp/Rocket Science Group, Zoom Communications Inc. (“Zoom”), or other third party companies to be determined should a need arise. If we contract with a third party to maintain, manage, or fulfill our Services to you, you will be notified and we will proceed only with your express verbal or written consent. We will not knowingly share any personal information with third parties without your consent.

We do not authorize third party service providers to make use of your personal information outside of what is described in this Privacy Policy, however, our Privacy Policy does not apply to the practices of third parties that we do not control or to people that we do not employ or manage. Please refer to the third party’s respective Privacy Policies for specific information about how they may use your personal information in connection with their respective services. JIPA shall have no responsibility for the use or misuse of your personal information by third parties.

JIPA reserves the right to disclose information about you as required by law, in response to legal process and law enforcement requests, and as necessary to protect the property, interests and rights of JIPA, its authorized affiliates, and others. In addition, JIPA may disclose information we possess about you as part of a merger, acquisition, sale of company assets, or transition of service to another provider, as well as in the unlikely event of insolvency, bankruptcy, or receivership in which your personal information would be transferred as one of the business assets of the company. We do not guarantee that any entity receiving such information in connection with one of these transactions will comply with all terms of this Privacy Policy.

How do I OPT OUT of communications?

We want to communicate with you only if you want to hear from us. If you prefer not to receive information from us, you may OPT OUT at any time at no cost to you. We do not discriminate against any who make such requests.

To OPT OUT, please let us know by emailing us at jill@jipadesign.com or by using the Contact Form. Please be sure to include your full name and the primary method of communication which you provided to us. It may take up to four (4) weeks to process your opt out request, during which time you may continue to receive communications from JIPA.

Note, opting out with us does not mean you have opted out with other third parties. Please consult third parties’ respective Privacy Policies and related policies for information regarding any related OPT OUT opportunities.

If you would like to request information about what we collect, please feel free to email or use the Contact Form. In accordance with California law, we will respond in writing to your request within thirty (30) days.

How do I access, change, delete, or move my personal information?

You have the right to access, rectify, and erase your data, the right to restrict and object to its processing, and the right to data portability.

Our Site does not currently use online profiles or accounts, but you may access, update, or delete your personal information from our records by emailing us at jill@jipadesign.com or by using the Contact Form.

Note, only you or a person registered with the California Secretary of State (or similar legal entity) that you authorize to act on your behalf may make a verifiable request related to releasing your personal information.

Your request to us must:

  • Provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it

We cannot respond to your request or provide you with the required information if we cannot:

  • Verify your identity or authority to make the request
  • Confirm that the personal information relates to you

You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.

Once your request is verified, we will disclose or deliver the required information within 45 days. The time period to provide or deliver the required information may be extended once by an additional 45 days when reasonably necessary and with prior notice. Any data we provide will only cover the 12-month period preceding the verifiable request’s receipt. Note, we retain the right to display work created as part of our Services on our Site, portfolio, and marketing materials unless otherwise agreed upon in writing.

How does JIPA protect children’s privacy online?

We will never knowingly request nor receive personal information from anyone under the age of 18.

Children (persons under the age of 18) may only use the Site in conjunction with and under the supervision of a parent or legal guardian. Persons under the age of 18 are not eligible to submit any personal information to us. 

If you are a parent or legal guardian of a child under the age of 18, and you suspect that child has given us personal information, please contact jill@jipadesign.com or use the Contact Form. We will verify whether we have received any information, and delete it from our records within thirty (30) days.

How does JIPA protect my personal information?

We are committed to protecting the security and integrity of your personal information, and we use procedures and technology designed for this purpose. For example:

  • We limit access to client personal information to those employees or independent contractors who have a business reason to know this information.
  • We maintain policies and procedures covering the physical security of workplaces and records.
  • We use technological means (such as backup files, virus detection software, firewalls, encryption, and other computer software and hardware) to protect against unauthorized access, alteration, disclosure, or destruction of client data.

We believe your data must be protected against loss and unauthorized access. On our Site, we use procedural and technical safeguards to protect your personal information against loss or theft as well as unauthorized access and disclosure to protect your privacy, including encryption, firewalls and Secured Socket Layer (SSL) encryption technology. SSL technology, an industry standard, is designed to prevent someone other than the operators of the Site from capturing and viewing your personal information.

JIPA never will ask you for your password(s) in any unsolicited communication (including unsolicited correspondence such as mail, email). While our third party vendors employ many different security techniques to protect such data from unauthorized access, perfect security does not exist on the Internet, and JIPA does not ensure or guarantee the security of any information you transmit to us on our Site or the accuracy of any information displayed on our Site. We do not accept liability for unintentional disclosure.

By using our Services or by providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Site and Services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Site or sending an email to you. You may have a legal right to receive this notice in writing. To receive a free written notice of a security breach (or to withdraw your consent from receiving electronic notices), please notify us at jill@jipadesign.com or through our Contact Form.

What about links to other web sites and services?

Our Site contains links to other sites beyond JIPA’s control, including LinkedIn.com, Redbubble.com, and others. JIPA is not responsible for the content or practices of any linked sites, and we provide these links solely for the convenience and information of visitors to our Site. JIPA does not control the privacy policies or practices of any third party sites. This Privacy Policy does not cover the collection of information by other companies and/or sites. JIPA is not responsible and shall not be liable for their activities, such as how they handle the information they collect online. You should review their policies before providing any personal information.

Does JIPA discriminate?

No. You have the right not to be discriminated against. You have the right not to be discriminated against for exercising any of your consumer’s rights, including by:

  • Denying goods or services to you
  • Charging different prices or rates for goods or services, including the use of discounts or other benefits or imposing penalties
  • Providing a different level or quality of goods or services to you
  • Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services

Updates to our Privacy Policy

From time to time, we may use information, including personal information, for new, unanticipated uses not previously disclosed in our Privacy Policy. If our information practices change regarding personal information previously collected, we will take reasonable efforts to provide notice and obtain consent to any such uses as required by law.

We may amend this Privacy Policy at any time by posting the amended terms on the Site. All amended terms shall automatically be effective immediately upon posting, and we will update the effective date provided below. If we make any changes to this Privacy Policy that we view to be material, we will notify you of those changes by posting them on our Site or by sending you an email or other notification. Your continued use of the Site after any change to this Privacy Policy will constitute your acceptance of such changes.

Governing Law; Limitation of Damages; Entire Agreement

This Privacy Policy is governed by the laws of the State of California. Venue for any dispute arising under this Privacy Policy shall be in the courts in and for Los Angeles County, California. By your use of our Site, you agree to be bound by the terms and conditions contained in this Privacy Policy. To the extent you may maintain any claims for liability against JIPA arising from a potential violation of this Privacy Policy or to the misuse of your personal information, you agree that your recovery for damages is expressly limited to those provided in California Civil Code Section 1798.84, as may be amended from time to time.

This Privacy Policy constitutes the entire agreement between you and JIPA regarding the use of our Site and Services. It supersedes any and all previous and contemporaneous oral and written agreements between you and JIPA regarding your use of the Site and Services.
